The 12-Month Rule

In Australia, individuals and trusts can discount their capital gain by 50% if the asset was held for more than 12 months. SMSFs receive a 33.33% discount. Companies do not receive a discount.

How CGT works for Real Estate

Capital Gains Tax is not a separate tax; your 'Taxable Capital Gain' is added to your other assessable income in the financial year you exchange contracts (not the settlement date).

For high-value commercial sales, this often pushes the seller into the highest marginal tax bracket (47%). Structuring your purchase in a Trust or SMSF at the beginning of the journey is critical for protecting your exit equity.

Common Deductions to Base Cost

  • Stamp Duty: The tax paid on purchase is added to your cost base.
  • Capital Improvements: Renovations or major structural repairs.
  • Selling Costs: Agent commissions, marketing, and legal fees.
